Medical documentation in pre-hospital care

The topic of this bachelor thesis is Medical documentation in pre-hospital care. This work was divided into two parts. The first part was theoretical, the second practical research. In the theoretical part, the emergency medical service is described with its basic elements and history. Furthermore, the issue of medical documentation was described in general view with its most important aspects. In the last part, the pre-hospital medical documentation service was described by actual examples. Four goals were set in the practical part. The first was to find out the opinion of paramedics on the documentation they are filling and writing as a part of the prehospital care. The second goal was to find out the opinion of paramedics on this documentation in case of need to prove their lege artis procedure. The third goal was to find out the benefits of changes of the software that is used to manage medical documentation. The last goal was to find out how this documentation is subsequently used in the hospital after the handover. The method of qualitative research in the form of semi-structured interviews was chosen for the practical part. The research samples for the first two goals consisted of 12 paramedics, each of whom was asked 19 main questions, additional subquestions were asked in a case the interview led to them. For the third goal, the research sample consisted of 8 informants, who were asked 6 main questions, which were also developed appropriately by additional subquestions if needed. For the last goal there was research sample of 5 informants from the ranks of nurses in the hospitals. The goal of the research is to point out the most important matters of the pre-hospital documentation that is filled in by the paramedics and their opinion on the changes that were made during last year. The work can serve as a basis for possible changes in the management of medical documentation in the conditions of the emergency medical services.
The Duty of Confidentiality in Health Care (Section 99 of Czech Criminal Procedure Code and other provisions)

The Duty of Confidentiality in Health Care (Section 99 of Czech Criminal Procedure Code and other provisions) The aim of the thesis is to introduce the issue of medical confidentiality in Czech Republic. Although most stress is put on the connection with criminal law, the work also explains what medical confidentiality is and outlines some disputable points in this field as well as it further on mentions international treaties, statutes and other sources where the duty of confidentiality is incorporated. The thesis then shows medical confidentiality in connection with the matter of medical records and afterwards focuses on the exceptions when duty of confidentiality can legally be broken and finally a chapter is given to describe the questions of lability for breaching the duty of cofidentiality in health care where criminal law consequences and disciplinary consequences are described. All the matters are discussed in the light of the Health Services Act (372/2011 Coll.) which came into force on April 1, 2012.
Protection of personal data in healthcare

The thesis deals with the rules of the protection of personal data in the process of rendering healthcare. This topic is highly relevant because the act no. 89/2012 Coll., The Civil Code, came recently into force and influenced the topic of this thesis, mainly in case of the settlement called "The Healthcare". The work is divided into four chapters. The first chapter contains the most important legal sources for the protection of personal data in the process of rendering healthcare. The chapter also describes the major decisions of the European Court of Human Rights and the most important decisions of courts in Czech Republic. The second chapter deals with the protection of personality, right to privacy and with the protection of personal data. The protection of personal data in healthcare is undoubtedly a part of above mentioned rights. The third chapter deals with the duty of confidentiality of healthcare workers, the possibility of breaking the confidentiality and the legal liability for breach of a duty of confidentiality. The fourth chapter describes the regulation of medical records. The conclusion includes an evaluation of existing legal regulation and proposals de lege ferenda. Protection of personal data in the course of rendering health care

Health care services is an area, in which is, with regard to specific nature of processed information, needed to pay special attention to personal data protection of patients. Act that used to regulate this kind of relations for more than 40 years was the Act on Care and Health of Nation. Taking into consideration its historic time of origin and paternalistic theory, on which it was based upon, and despite passage of Convention on Human Rights and Biomedicine meaning significant deviation from up to now paternalistic theory, this Act was not able stand under the Czech republic international obligations, principles of democratic legal state and last but not least rapid technological progress,. Therefore it was replaced by Medical Services Act, which is in full compliance with approach that sees relation between physician and patient as equal. One of cornerstones in area of personal data protection in health care services is concept of rule of secrecy, to which is obliged mainly provider of health care, but also other persons stated in the Act. The concept of personality rights and their protection, as well as the view on provision of health services has changed a lot. In relation to recent development in the field of private law there is a need to examine the aspects of personality rights separatelyy and also in broughter context. This Master's thesis sets as its goal to follow the current legislation and to point out situations where the personality rights can be especially endangered. The second goal is to evaluate current legal issues in foreign countries of the protection of personality rights in relation to the provision of health services in order to see if there is a probability that Czech law will have to deal with similar problems in the future as well. In the first part the concept of personality rights and their protection is introduced. The aspects related to the provision of health services that may be especially endangered are highlighted. Also the possibilities of resolving situations where there is infringement of personality rights are presented. The subject of this thesis is "Protection of personality in health care" which is an important and especially current topic. After the recodifications of relevant legislation - particularly the recent Civil Code (which is built on the natural law concept) - is more focused on the protection of personality and it generally changed perception of harm to personal rights. It is newly called "compensation for personal harm to the natural rights of person" and claims for compensation for damages and recompense of non-pecuniary damages is tied to a single court proceedings. The thesis is divided into four parts. The first part introduces the basic concepts related to personal rights and to certain medical terminology including explanation of the term "lege artis". Aplication of drugs based on telephone orders

The topic of this work is the administration of medicine following a face-to-face and telephone madication-related orders at hospitals. The methods used in the theoretic part of this work included both discussions with representatives of health care providers and the analysis of documents. Based on the description and analysis of the set-up of verbal madication-related orders as featured in the accreditation standards of four healthcare accreditation organisations and internal rules of five hospitals, the author of this work seeks to identify any possible risk elements of verbal orders, and to propose ways how to modify such parts of standards and rules so as to make the verbal ordination less risky. Whether or not the verbal medication-related orders at hospitals is a lege artis procedur depends first of all on the situation in which the verbal order is issued, on the authorization or qualifications of health employees who are involved in the implementation of such verbal order, and on the strict observance of procedures concerning the communication (including its recording into the medical documentation). Nurses' duty of conifidentiality and the consequences of its breach

The aim of my thesis was to find out what is the legal awareness of nurses in the issue of confidentiality. Furthermore, it was examined whether nurses know what are the consequences for unauthorized access to the medical records. The theoretical part of this thesis describes the mandatory confidentiality issue and its consequences. And it defines the concepts of personal and sensitive personal data. In addition the conditions under which it is required to break confidentiality and the consequences of breach of legal obligation are mentioned. Describe the legal responsibility of nurses. In the practical part of the work I use qualitative methods of data collection, interview, for me to respond to major and minor research questions. I use interviews conducted with nurses, for doing analysis of the case and to describe the measures taken by the employer at the Municipal Hospital in Litoměřice.
